1. Acceptance of Terms

By accessing and using DripCollector ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are of legal age to form a binding contract and meet all eligibility requirements. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

The Service is not available to residents of jurisdictions where the purchase of randomized product packs may be restricted or prohibited by law. It is your sole responsibility to determine whether your use of the Service complies with applicable local laws and regulations. DripCollector reserves the right to restrict access from specific jurisdictions.

3. Nature of the Service

DripCollector is an entertainment platform that offers randomized digital pack openings ("Rip Packs") featuring authentic designer fashion items. The Service is designed for entertainment purposes. When you purchase a Rip Pack, you are paying for the entertainment experience of a randomized item reveal, not for a specific item.

DripCollector is an independent platform that sources authentic goods for resale through legitimate retail and resale channels. Items available through the Service may be sourced from third-party marketplaces and acquired at the time of your winning pull or held in our warehouse inventory prior to fulfillment.

4. Randomized Outcomes

Rip Packs contain randomized items. By purchasing a Rip Pack, you acknowledge that outcomes are determined by chance and the value of items received may vary. All sales are final.

5. No Refunds Policy

All purchases of Rip Packs are final and non-refundable. Once a pack is opened, the transaction is complete. This policy exists because:

  • You are paying for the entertainment experience of a randomized reveal
  • The random outcome is delivered immediately upon purchase
  • The nature of randomized content makes refunds impractical

By making a purchase, you waive any right to a refund based on dissatisfaction with the random outcome received.

6. Item Fulfillment & Shipments

When you win an item through a Rip Pack or Drop, the item is added to your digital wardrobe. To receive the physical item, you must request a shipment through the Service. The shipment process works as follows:

  • You create a shipment and provide your full name, shipping address, and phone number
  • A shipping quote is generated based on shipping costs, customs duties, and applicable taxes for your destination
  • Once you pay the shipping quote, DripCollector sources the item from verified retail and resale channels and ships it to our warehouse for processing
  • After the item is received, inspected, and verified at our warehouse, it is shipped to your provided address

You acknowledge that:

  • Items are subject to availability at the time of sourcing. In rare cases where an item becomes unavailable, DripCollector will provide a comparable alternative or account credit at its discretion
  • Delivery times vary depending on seller shipping, warehouse processing, and carrier transit to your destination. Estimated delivery is 2-4 weeks from shipment payment
  • Items are pre-owned unless otherwise stated and may show signs of wear consistent with their marketplace description
  • Shipping costs, customs duties, import taxes, and any fees imposed by your local customs authority are your responsibility and are included in your shipping quote
  • DripCollector is not responsible for delays caused by customs inspections, carrier issues, or force majeure events

7. Wardrobe & Sellback

Items won are stored in your digital wardrobe. Your wardrobe represents your claim to the corresponding physical items, which are sourced and fulfilled when you request shipment. You may choose to:

  • Request physical shipment of the item (see Section 6)
  • Sell the item back to DripCollector at the offered sellback rate within the limited sellback window
  • Hold the item in your wardrobe indefinitely

Instant sellback is available for a limited time after acquiring an item. The sellback rate is a percentage of the item's value determined at our sole discretion. Once the sellback window expires, the option is no longer available. Sellback credits are added to your account balance immediately.

8. Account Credits & Virtual Currency

Account credits ("USDC balance") represent a prepaid balance for use within the Service only. Credits are non-transferable, have no cash value, and cannot be exchanged for cash except through legitimate withdrawal processes when available. Unused credits may expire or be forfeited upon account termination.

9. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to manipulate, exploit, or abuse the Service or its mechanics
  • Create multiple accounts to circumvent limits or restrictions
  • Engage in chargebacks or payment disputes in bad faith
  • Harass, abuse, or threaten other users or staff
  • Use automated systems, bots, or scripts to interact with the Service

Violation of these rules may result in immediate account termination, forfeiture of credits and items, and potential legal action.

10. Intellectual Property & Trademark Disclaimer

All content, branding, and materials on the Service are owned by or licensed to DripCollector. Third-party brand names, trademarks, logos, and trade dress referenced on this platform are the property of their respective owners and are used solely under the principles of nominative fair use to accurately identify and describe the authentic products available through the Service.

DripCollector is an independent platform and is not affiliated with, endorsed by, sponsored by, or associated with OTB Group (parent company of Maison Margiela), Acne Corporation (Acne Studios), or any other brand, designer, manufacturer, or trademark holder whose products may appear on this platform. No sponsorship, endorsement, or official relationship is implied.

DripCollector does not manufacture, produce, or create any of the products featured on the platform. All items are authentic goods acquired through legitimate retail and resale channels.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAKE NO WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR INFORMATION PROVIDED THROUGH THE SERVICE.

DRIPCOLLECTOR GUARANTEES THE AUTHENTICITY OF ALL ITEMS SOURCED THROUGH THE SERVICE. ITEMS ARE ACQUIRED FROM AUTHORIZED RETAILERS AND VERIFIED RESALE PLATFORMS. IN THE EVENT ANY ITEM IS DETERMINED TO BE COUNTERFEIT, DRIPCOLLECTOR WILL PROVIDE A FULL REFUND OR REPLACEMENT AT ITS SOLE DISCRETION.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIPCOLLECTOR AND ITS OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless DripCollector and its operators from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of a third party.

14. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
